<p>I was sitting in a local restaurant by myself for lunch this week when I overheard two gentlemen talking about foreclosure properties. Both of these men had their own opinions regarding the market and where to find the best deals. It was interesting listening to both men’s opinions and interesting enough, both of them were wrong. It is amazing how many people claim to be subject matter experts but have no formalized training or accreditation to support their hypotheses. </p>
<p> </p>
<p>According to national statistics there are approximately 2,203,295 foreclosure filings and about 1,285,873 foreclosed properties on the market today. The substantial increase in foreclosures has flooded the supply of available properties which then forces home values to decrease. We all learned about supply and demand in high school economics class and many home owners are feeling the effects today. </p>
<p> </p>
<p>Finding that deal may not be as easy as it may seem, you need to look beneath the dirt. Understanding the value of a home, cost of repairs and legalities of submitting an offer is critical and you need the help of a licensed Real Estate Expert to navigate you through the foreclosure maze. Get with a Realtor team that has the resources and connections to help you with every step of the purchase transaction. </p>
<p> </p>
<p>Great Realtors, or as I call them the top 1%, will have a “Dream Team” that will be able to work with the client. They will have a solid mortgage broker, a reputable property appraiser, a reliable insurance agent, a mold consultant, a conscientious property inspector, an esteemed general contractor and a renowned ASP certified staging professional. Being able to go to one Realtor and obtain all the necessary professionals to complete a transaction is critical. </p>
<p> </p>
<p>Having a team of these professionals will reduce your exposure of making a mistake and buying a home that is not of value or has too many substantial repairs to make it worth the investment. It is important to use a professional Realtor who is experienced, trustworthy and a true professional. </p>
<p> </p>
<p>Here are some essential tips you need to know when you start your foreclosure prospecting.</p>
<p> </p>
<p> Pick out a geographical area that you would be okay with living, even if this is a property you plan on using as an investment. It is easier to rent a property with outstanding schools, shopping and amenities. Understanding and qualifying the benefits of a surrounding area will ensure you are picking a good location. A Realtor can provide you with any additional information you may need to pick the area.  Understand and research the average dollar per square foot for homes in the area you are looking. If you are looking at foreclosure properties that are $ 39 per square foot and the average home price is currently selling for $ 52 per square foot are you getting a great deal? The truth in the matter is that if the property you are looking at is a 3 bedroom, 2 baths, and 2 car garage property and is 1700 square feet, your deal is only $ 22,100 less than the average home price. Now add into that your repair cost then ask yourself again is this a good deal. If your repair cost in this example exceeds 50% of the difference, you are probably better off not purchasing a foreclosure and going with a turn key property. Understand the foreclosure law in your own state. You can research this easily enough on the web. You should know the difference between Foreclosure by Judicial Sale and Foreclosure by Power of Sale.  You will need to pick a 1% Realtor to assist you in selecting properties. They will listen to what you are looking for and search for homes that exceed your criteria but still within your price range. They will be able to conduct a market analysis on the area to provide you with sales data of homes that sold in that area. They will also arrange for all the showings and provide you with listing flyers that give you pertinent information. And as stated earlier, a 1% Realtor will give you access to their Dream Team of real estate professionals.  Once you narrow your search down, you will need to determine an offer. How much should you pay is a question that your Realtor should be able to help with. Extremely inexpensive homes that are substantially lower in price than the market average maybe the best buy depending on the repair cost. The only other advice I can give on making an offer or bid is you need to be decisive and take action. I have had several clients second guess the market and like the two men from lunch determine that the market has not hit bottom yet and that there are better deals out there only to have the right property sold from right under their noses. The great deals don’t stay on the market long so you need to be able to act fast. Most banks require proof of funds or for you to be pre-qualified before you bid or make an offer on these foreclosed properties.

<p>The bottom line is there are great deals beneath the dirt of a foreclosure. Having a vision of what that looks like for you as the buyer is important. Understanding what you are looking for in a property a year from now is the perspective that you need to have. Many clients that buy homes spend money on remodeling, changing out carpets or cabinets, or putting in new floors. If you are going to go through and spend money on a property improving it to your taste why not get that property at a bargain-basement price. <p>I loved this story of a property in the Byron Hinterland being sold in the $mil and a half region. It seems the potential new owners discussed the purchase with their psychic Geomancer &#8211; this is like a Feng Shui expert. They were told that the vendors were not yet ready to leave this property and that they should wait for a more auspicious time. When told this news, the vendors did what any sensible Byron property owner would do – called in their personal shaman for a full psychic cleanse and sage smudging. Negotiations are now proceeding smoothly. <br />&#13;</p>
<p>Lo Doc Loans and Tax<br />&#13;</p>
<p>For some time now the ATO have been rattling their swords over Lo doc loans. It seems &#8211; Shock! Horror! – some people have been exaggerating their declared income when going for a loan while minimizing it when filing with the tax Department. It is understandable, I suppose, that the ATO would wish to tax the Great Australian Tax Payer at the higher figure if given the chance and this, apparently, is what they intend to do. <br />&#13;</p>
<p>A recent story from Crikey.com states the commissioner of the ATO Michael D’Ascenzo is saying he knows that people are fibbing on their Lo Doc Loan declarations and declares that if any are caught during an audit then the higher figure will be what is the taxable amount. Of course brokers have been made out to be the baddies in this situation as well but the real story here is this is just another indication of the coming tightening of monetary policy. If Paul Keating was still around he would say this is the “credit squeeze we have to have!”<br />&#13;</p>
<p>Put out the &#8220;Fire Sales&#8221;<br />&#13;</p>
<p>In a similar vein, our local member Don Page is behind a move to stop Mortgagee-in-Possession auctions going on as &#8220;Fire Sales&#8221;. The banks and agents are only interested in getting back the mortgage debt when someone defaults on their loan with no interest in helping the vendor retain as much equity as possible. If the new law is accepted it means that if a house is sold under value, the Mortgagee can be held accountable for the balance and all effort must be made to properly promote and list the property (not just ring up a mate and do a deal!) </p>

<p>Buyer&#8217;s Market<br />&#13;</p>
<p>Domain.com pointed out that last weekend there were twice as many properties going to auction in Sydney than normal &#8211; about 1300 &#8211; nearly double the previous average of 590. However clearance rates have sunk to 63%, which is the lowest since August 2005. That is a statistic verifying my intuition that we have quickly turned from what was expected to be a boomer season for agents into a bit of a bear market. The future &#8211; no one will predict but I feel the sentiment is equal between those saying we will have a soft 6 &#8211; 12 months to the doom and gloomers saying we are in for an extended rough patch.</p>

<p>If only the walls could speak&#8230; Solana Beach Homes would have a lot to say. Full of history and character these homes are beautiful and absolutely modern in every sense of the word.</p>
<p>The area today known as Solana Beach was originally occupied, like much of the United States, by Native American tribesthe first of these in known history were the San Dieguitos. They came around 9000 BC from eastern California and Nevada on the trail of the animals they hunted: mastodons, bison, and camels. The San Dieguitos were replaced in the Solana Beach area by the La Jollans which eventually must have followed their prey on down to Mexico who lived on seafoods and seeds. The La Jollans, in turn, were either replaced or simply absorbed by the Kumeyaay, who hailed from the Colorado River region and also liked their fish, as well as acorns and nuts.</p>
<p>Then came the Spanish, arriving in 1769. Control of the land passed from the Spanish to the Mexicans and eventually to the United States; California was officially admitted to the Union in 1850, but the Solana Beach area was still largely dominated by the old Mexican land owners, known as the Californios, until the 1860s. Solana Beach, originally dubbed &#8220;Lockwood Mesa,&#8221; had its first Anglo settlers, the George Jones family, in 1886. Oldest remaining house in Solana Beach is the Stevens house. The house was built in 1887 or 1888. Grandma Susannah Stevens lived there until her death at just short of 105 years of age in 1927. She wasn&#8217;t the first historical resident of the Solana Beach area to live to a ripe old age; another settler, Grandpa Frank Knowles, lived to be 104. Maybe it&#8217;s that sea air.</p>
<p>Today, the Stevens House is located in La Colonia Park and is the home of the Solana Beach Heritage Museum.</p>
<p>The building of the Lake Hodges Dam in 1917-18 and the 1918 creation of the 12,000-acre Santa Fe Irrigation District spurred the rapid development of Solana Beach. It began to boom in the &#8217;20s, and in 1922, Colonel Ed Fletcher bought 140 acres from George H. Jones to develop the town of Solana Beach. Solana Beach became known as a center for growing avocados.</p>
<p>In 1925 Independence day, access to the beach was needed for development so hydraulic water pressure was used to create the local favorite Fletcher Cove Beach.</p>
<p>Late 1960s and throughout the 1970s other changes have made their marks through the years from the Depression and World War II to the construction, with the revival of the money market, of hundreds of premium Solana Beach homes. The Solana Beach Women&#8217;s Club, which became the Civic and Historical Society in 1989, renovated the central plaza and installed the &#8220;Sun Burst Fountain,&#8221; among other beautification projects. Solana Beach was officially incorporated in 1986, and it has since acquired two community centers and a train station.</p>

Interior has been upgraded &#038; remodled, but will need a new roof in next 10years. Home inspection shows about $2-3k in minor repairs if done by contractor(most of which we could do ourselves &#038; save $1-2K). Bank is loosing 100k on this house because previous owner bought it at 320k when market was high(they will have to forgive debt). My feel is that with the market so bad now, they should take less because it&#8217;s only selling for 6k less than appraisal. My realestate agent said they wont(I saw bank letter), they&#8217;d rather foreclose on owners &#038; try to recoup that way. Is there a website or how would I know what other homes in 95973 area sold for recently based on appraisal amount? Or how would I get this information? Please don&#8217;t say from realator, we cannot get anything from him and for personal reasons cannot fire him.</p>

It&#8217;s a short sale so bank is saying they abosolutely will not take less than 214k. 54yr old house appraised at 220k. Interior has been upgraded &#038; remodled, but will need a new roof in next 10years. Home inspection shows about $2-3k in minor repairs if done by contractor(most of which we could do ourselves &#038; save $1-2K). Bank is loosing 100k on this house because previous owner bought it at 320k when market was high(they will have to forgive debt). My feel is that with the market so bad now, they should take less because it&#8217;s only selling for 6k less than appraisal. My realestate agent said they wont(I saw bank letter), they&#8217;d rather foreclose on owners &#038; try to recoup that way. Is there a website or how would I know what other homes in 95973 area sold for recently based on appraisal amount? Or how would I get this information? Please don&#8217;t say from realator, we cannot get anything from him and for personal reasons cannot fire him.</p>
